§ 50.151 USER CHARGE SYSTEM.
   (A)   The sewer user charge system shall result in the calculation of three unit charges:
      (1)   An Administrative, Operation, Maintenance, and Replacement fee to be calculated based on the volume of water used by wastewater customers and the total administration, operation, maintenance, and replacement costs incurred by the city to be assessed on a per thousand gallons of water used basis.
      (2)   A Debt Service fee to be calculated based on the number of wastewater customers and the total debt service costs incurred by the sewer system.
      (3)   A Surcharge Rate to be applied to all over-strength wastes to be based on the strength and volume of such wastes and the excess costs of treatment of such wastes.
   (B)   Annual Review. The city shall review not less often than annually the wastewater contribution of users, the total costs of administration, operation, maintenance, replacement, and debt service of the sewer system, and the approved user charge system. The city shall revise the charges for users to accomplish the following:
      (1)   Maintain the proportionate distribution of administration, operation, maintenance, replacement, and debt service costs among users,
      (2)   Generate sufficient revenue to pay the total administra tion, operation, maintenances replacement, and debt service necessary for the proper operation, maintenance, and replacement, of the treatment works; and
      (3)   Apply excess revenues collected to adjust future rates accordingly.
   (C)   Notification. The city will notify each user at least annually in conjunction with a regular will or other mailing, of the rate attributable to the user charge.
   (D)   The Sewer User Charge System shall take precedence over any terms or conditions of agreements or contracts between the city and users which are inconsistent with this chapter.
