(A) Survey requirement. Prior to the installation of speed humps, a survey shall be conducted among all residents within the affected neighborhood to determine community support. The petitioner seeking the speed humps shall be fully responsible for all fees and maintenance described in this subchapter.
(B) Survey distribution.
(1) The city shall initiate the process for voting on proposed speed humps by distributing a survey to the residents residing in areas where the installation of speed humps is under consideration.
(2) The survey shall contain information regarding the proposed speed humps, their potential impact, and a request for residents' feedback and preferences.
(C) Survey duration.
(1) The survey period shall last for a total of thirty (30) days from the date of distribution.
(2) The city will establish the start and end dates for the survey and ensure that residents have ample time to review the information provided and submit their responses.
(3) Affected residents may complete the survey during the designated thirty (30) day period.
(D) Determination of satisfactory survey.
(1) For the survey to be considered satisfactory, a minimum of eighty percent (80%) of the distributed surveys must be returned to the city.
(2) The eighty percent (80%) threshold is established to ensure that a substantial portion of affected residents has had the opportunity to express their views on the proposed speed humps.
(E) Survey results.
(1) Once the survey period concludes and the city has collected the surveys, the results shall be tabulated and analyzed.
(2) The city shall consider the feedback received from residents in making decisions regarding the installation of speed humps.
(F) Super majority support. A minimum of eighty percent (80%) of households within the affected neighborhood must agree to the installation of speed humps. (Each household shall count as one signature toward the survey.)
(G) Voting eligibility. Only property owners are eligible to vote on a speed hump survey.
