§ 34.70 NOTICE REQUIRED.
   (A)   When an employee is terminated, unless he has been terminated for gross misconduct, COBRA requires the department head to notify the plan administrator (the Mayor) within 30 days. The 30-day period applies to death, termination of employment, or reduction in hours or eligibility of a covered employee. If the employee becomes divorced, legally separated, or one of his dependent children reaches the age of majority, the employee, or other qualified beneficiary, must notify the plan administrator within 60 days after the event. Regardless of the nature of the qualifying event, within 14 days after being notified, the plan administrator must notify all qualified beneficiaries of their rights to continued coverage. This notice will be sent by certified mail. All provisions subject to change as determined by COBRA.
   (B)   The period of continued coverage is 18 months, or as otherwise established by COBRA, for an employee terminated for reasons other than gross misconduct or for any employee whose hours of employment are reduced below the amount required to retain benefits under the plan. The continued coverage is 36 months, or as otherwise established by COBRA, for non-coverage due to death, medicare eligibility, divorce, legal separation, or when a dependent child exceeds the maximum age for coverage.
