§ 34.46 HOLIDAY PAY.
   (A)   Police Department and Fire Department.
      (1)   All active members of the Fire and Police Departments shall receive ten holidays during each calendar year. Pay for holidays shall be paid for those holidays with payroll for pay period in which holiday occurs. Amount of payment for each holiday will be determined by the annual salary ordinance.
      (2)   Holidays must be identified by the City Council’s annual salary ordinance or by Board of Works resolution.
   (B)   Full-time and salaried employees.
      (1)   All full-time and salaried members of any department (except police and firefighters on their respective pension plans) shall receive all holidays prescribed by state statute, plus the primary and general election days. Holidays must be identified by the City Council’s annual salary ordinance or by Board of Works resolution.
      (2)   When any of these holidays, other than Sunday, falls on Sunday, the following Monday shall be observed as the holiday. Any holiday which comes on Saturday, the preceding Friday shall be observed as the legal holiday.
      (3)   Due to the nature of the work required in some departments, holidays may vary. If any full-time employee is required to work or render service on a holiday recognized by the city, he will be given another day off in lieu of the holiday. If allowing the employee another day off causes a department hardship (workload, vacations or personal days), the employee will be compensated at a rate of double time for the holiday worked.
      (4)   Part-time and seasonal employees of the Street, Water, Wastewater, Park, and Police Departments who have worked an average of 20 hours or more per week during each of the weeks of the two pay periods immediately preceding a paid holiday for those Departments will be eligible for partial holiday pay. The rate of pay for such holidays shall be the same as that employee’s normal pay rate. The amount of pay shall be determined by multiplying the average amount of time such employee worked per workday during the two preceding pay periods, ending at 12:00 midnight on the Sunday preceding the holiday, not to exceed eight hours, times that employee’s rate of pay.
      (5)   Any employee absent without authorization on the day preceding and/or following a holiday will not be compensated for the holiday.
