§ 34.17 OVERTIME.
   (A)   Police Department.
      (1)   No member of the City Police Department shall be required to work more than 160 hours during a 28-day work period (unless compensated at 1½ times his regular rate of pay or given compensatory time-off at 1½ time rate).
      (2)   Overtime pay for hours worked over 160 hours shall be paid in conformity with requirements of the Fair Labor Standards Act.
      (3)   Compensatory time should be mutually agreed upon by the employee and the city. In the absence of an agreement, the Police Chief will make the final determination.
      (4)   In cases of public emergency, to be determined by the Board of Public Works and Safety, members of the Police Department may be assigned to such duty hours as the Board of Public Works and Safety may deem necessary.
      (5)   No member of the Department shall leave his post of duty until properly relieved or until excused by his superior officer.
      (6)   Police officers are expected to work a reasonable amount of overtime when requested except for good and sufficient cause. The Police Chief will maintain a record of overtime worked by each police officer and will be responsible for equalizing overtime among the police officers in the Department to the maximum extent possible.
      (7)   A civilian radio dispatcher shall not be required to work more than 40 hours in any seven- day work week (unless compensated at 1½ times his regular rate of pay or given compensatory time off at 1½ time rate).
         (a)   A civilian radio dispatcher is considered an hourly employee and is entitled to all benefits spelled out in this chapter for all hourly employees.
         (b)   Overtime pay of hours worked over 40 hours shall be paid bi-weekly. Compensatory time must be taken within the seven-day work cycle (12:01 a.m. Monday to 12:00 midnight Sunday).
   (B)   Fire Department.
      (1)   No member of the City Fire Department shall be required to work more that 212 hours during a 28-day work period (unless compensated at 1½ times his regular rate of pay or given compensatory time off at 1½ time rate).
         (a)   Volunteer firemen that work a regular shift for a full-time fireman due to illness, vacation or other reason, are considered temporary labor and paid hourly according to the annual salary ordinance. Should a volunteer fireman who has been classified as temporary labor be required to work more than 212 hours during a 28-day cycle, he will be compensated for the overtime at 1½ times his temporary hourly rate of pay. A volunteer fireman’s per annum salary established by the annual salary ordinance shall be adjusted by hourly pay received.
      (2)   Overtime pay for hours worked over 212 hours shall be paid in conformity with requirements of the Fair Labor Standards Act.
      (3)   The Fire Department work day will be 24 hours. This 24-hour day will be used to figure pay for work day, vacation, and excused sick or personal days. Firefighters shall work 24 hours and are off 48 hours. If fire personnel are called to work anytime during their 48 hour off-time, they must be paid according to division (B)(1) of this section.
      (4)   Compensatory time should be mutually agreed upon by the employee and the city. In the absence of an agreement, the Fire Chief will make the final determination.
      (5)   In cases of public emergency, to be determined by the Board of Public Works and Safety, members of the Fire Department may be assigned to such duty hours as the Board of Public Works and Safety may deem necessary.
      (6)   No member of the Department shall leave his post of duty until properly relieved or until excused by his superior officer.
      (7)   Firefighters are expected to work a reasonable amount of overtime when requested except for good and sufficient cause. The Fire Chief will maintain a record of overtime worked by each firefighter and will be responsible for equalizing overtime among the firefighters in the Department to the maximum extent possible.
   (C)   Full-time employees.
      (1)   No full-time or part-time employee of the city, its departments or utilities shall be required to work more than eight hours in any 24-hour period, except in cases of emergency to be determined by the appropriate governing body, or the department head. All hourly employees will work 40-hour week schedule (12:01 a.m. Monday to 12:00 midnight Sunday), unless stated otherwise by the annual salary or other city ordinances. This section applies to all personnel not considered salaried, except for Police and Fire Department members.
      (2)   Overtime pay of hours worked over 40 hours shall be paid bi-weekly. Compensatory time must be taken within the seven-day work cycle (12:01 a.m. Monday to 12:00 midnight Sunday).
      (3)   Compensatory time should be mutually agreed by the employee and the city. In the absence of an agreement, the department head will make the final determination.
      (4)   All employees of the city are expected to work a reasonable amount of overtime except for good and sufficient cause. Each department head shall maintain a record of overtime worked by each employee and shall be responsible for equalizing overtime among the employees in his department to the maximum extent possible.
      (5)   No hourly employee shall leave his post of duty after eight hours of duty until properly relieved or until excused by the department head or his representative.
