(A) The unlawful manufacture, distribution, dispensing, possession or use of a controlled substance is prohibited in any city department or workplace.
(B) That any employee of the city violating division (A) above or any employee convicted of a violation of any criminal drug statute as a result of a violation occurring in the workplace shall be subject to the disciplinary procedures set forth in this chapter, or 36-8-3-4, or department rules and regulations as applicable, including termination. The employee shall notify his or her department head of any said conviction no later than five days after such conviction.
(C) This section confirms the city Employee Assistance Program available to employees of the city which may be available for education of the dangers of drug abuse in the workplace, as well as drug counseling and rehabilitation. Information concerning the Employee Assistance Program can be located in this chapter.
(D) Within 30 days after receiving notice of a conviction described in division (B), the city shall take appropriate disciplinary and/or counseling action toward the convicted employee.
(E) Upon passage of this section, a copy of this section shall be posted at the City Hall Annex and in each department of the city and each department head shall make their employees aware of said posting and shall maintain copies of this section for distribution to any employee requesting a copy of this section.
