§ 34.02 PHYSICAL EXAMINATIONS; EXCEPTIONS.
   (A)   The city shall have the right to require examination of any city employee at city expense by a physician chosen by the city for the purpose of determining mental, emotional, or physical fitness to perform the duties of his employment with the city or his entitlement to any benefits which he may claim are due him from the city.
   (B)   The following are exceptions to division (A) above:
      (1)   When a firefighter or police officer applies for a disability pension, the Police or Fire Pension Board of Trustees shall have sole authority to make decisions concerning this matter.
      (2)   A department head is permitted to require a doctor’s certification, at the employee’s expense, in cases of absence from duty for more than three working days.
      (3)   The respective pension board will pay 50% of the cost of any physical and mental examinations required by the city, by the pension board, or by statute for applicants for positions as police officers or firefighters in the city, and the respective pension board will pay 100% of the cost of such examinations for a successful applicant for such a position.
      (4)   Any city employee believed to have a drug or alcohol dependency or emotional problem causing tardiness, absenteeism, or deterioration of job performance, may be required to visit the South-western Indiana Mental Health Center, Inc., (Employee Assistance Program). The initial visit is at city’s expense. The cost of additional visits, as directed by the Employee Assistance Program, will be the financial responsibility of the employee.
         (a)   An employee is subject to discharge for failure to comply after receiving written notification to visit the Employee Assistance Program.
         (b)   All visits to Employee Assistance Program are strictly confidential. The city is notified of visits only (not individuals by name).
