§ 97.31 REMEDY FOR FAILURE TO REPAIR.
   (A)   If any person, firm, or corporation making a cut or excavation in any public street, alley, parking lot, or public right-of-way of the city, fails to backfill or repair the cut or excavation in accordance with the terms of this subchapter, the city may give notice to that person, firm, or corporation that repairs to the cut or excavation must be completed within five days or the city will make necessary repairs and collect the cost of those repairs from the person, firm, or corporation making and failing to repair the cut or excavation.
   (B)   The city's election to proceed under this section shall be a remedy in addition to and not affecting the imposition of any fine for failure to comply with any other provision of this subchapter.
