(A) No significant industrial user (SIU) shall discharge wastewater into the POTW without first applying for and obtaining a wastewater discharge permit from the IDEM, except that a SIU that has filed a timely application pursuant to § 50.077 or has a valid permit issued by the IDEM of this chapter may continue to discharge for the time period specified therein.
(B) If the IDEM does not issue a permit to the SIU, then the Superintendent may require the SIU to obtain a wastewater discharge permit from the city, as necessary, to carry out the purposes of this chapter. The determination from IDEM shall be in writing. If the city issues a permit to the SIU, the permit will be issued in accordance with §§ 50.079 through 50.090 of this chapter.
(C) Any violation of the terms and conditions of a wastewater discharge permit shall be deemed a violation of this chapter and subjects the wastewater discharge permittee to the sanctions set out in §§ 50.130 through 50.153. Obtaining a wastewater discharge permit from either the city or the IDEM does not relieve a permittee of its obligation to comply with all federal and state pretreatment standards or requirements or with any other requirements of federal, state, and local law.
