§ 36.41 CONTRIBUTION.
   (A)   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   DEFERRED COMPENSATION PLAN. The deferred compensation plan established by § 36.40.
   FULL-TIME EMPLOYEE. An employee who has been on active duty regularly, working in excess of 32 hours per week for more than 26 consecutive weeks. The term shall include the elected position of Clerk-Treasurer. The term shall not include employees of the city police and fire departments who are members of their respective pension plans.
   REGULAR WEEKLY WAGES. Weekly wages earned by a full-time employee for work performed, not to exceed 40 hours per week, or an employee’s base salary. This amount shall not exceed the base hourly wage times 40 hours worked (or fewer hours if the employee does not work 40 hours in a given week) or the base salary, as both are established by the annual salary ordinance.
   (B)   The city, after proper budget and appropriations, shall contribute an amount, not to exceed three percent of a full-time employee’s regular weekly wages, to the full-time employee’s deferred compensation plan account. This contribution by the city will be made regardless as to whether the employee makes individual contributions.
   (C)   If a full-time employee elects, the full-time employee may waive the contribution authorized by this section by signing a waiver of benefits form and delivering the form to the Clerk-Treasurer.
