§ 154.32 CLASSIFICATION AND APPROVAL PROCEDURE.
   The City Planner shall determine whether the sketch plan constitutes a minor or major subdivision and shall notify the applicant of the classification within 20 days from the date that the sketch plan is submitted to the City Planner.
   (A)   Minor subdivision. If the sketch plan constitutes a minor subdivision, the applicant may proceed directly to the filing of an application for approval of a final subdivision plat as provided in these regulations. The City Planner shall determine, according to § 154.38 herein, whether the minor subdivision plat may be approved administratively by the City Planner or whether to place the matter on the next available regular meeting agenda of the Planning and Zoning Commission for formal approval or disapproval.
   (B)   Major subdivision. If the sketch plan constitutes a major subdivision, the City Planner shall issue a notice to proceed only if the sketch plan complies with all applicable laws governing the subdivision of land. The notice to proceed shall include, as appropriate, recommended changes in the sketch plan to be incorporated into the preliminary plat to assist the applicant in obtaining preliminary plat approval from the Planning and Zoning Commission. If the City Planner determines that the sketch plan does not comply with all applicable laws governing the subdivision of land and the applicant refuses to modify the sketch plan, the City Planner shall issue a notice of noncompliance. The City Planner shall issue either the notice to proceed, or the notice of non-compliance not later than 20 days after the date on which the sketch plan was submitted to the City Planner. After receipt of a notice to proceed, the applicant must first file an application for approval of a preliminary plat, as provided in these regulations, before filing for final subdivision plat.
