For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
FIXED BUSINESS LOCATION. A location within the city which complies with the Zoning and Building Code of the city and which is occupied by the same business for 30 consecutive days.
INTERSTATE COMMERCE. Soliciting, selling or taking orders for or offering to take orders for any goods, wares, merchandise, photographs, newspapers or magazines or subscriptions to newspapers or magazines which at the time the order is taken are in another state or will be produced in another state and shipped or introduced into this city in the fulfillment of such order.
ITINERANT VENDOR OR ITINERANT MERCHANT. Shall be construed to mean and include all persons, firms and corporations, as well as their agents and employees who engage in the temporary or transient business, in the city, of selling, or offering for sale, any goods and merchandise, or exhibiting the same for sale or exhibiting the same for the purpose of taking orders for the sale thereof, and who, for the purpose of carrying on such business or conducting such exhibits, either hire, rent, lease, or occupy any room or space in any building, structure or other enclosure or open space in the city, through or from which any goods or merchandise may be sold, offered for sale, exhibited for sale or exhibited for the purpose of taking orders for the sale thereof.
PEDDLER. Any person who goes from house to house, from place to place, or remains at one location for a temporary period of time, in the city soliciting, selling, or taking orders for or offering to sell or take orders for any goods, wares, merchandise, services, photographs, or publications and does not have a fixed business location within the corporate limits of the city.
TEMPORARY. The sale or offering for sale any goods, wares, services, or merchandise, including food products, to the general public without utilizing a fixed business location and does not include garage sales and does not continue for a period of time exceeding 72 hours.
