§ 110.15 DEFINITIONS; INAPPLICABLE TO AUTOMOTIVE DEALERS, SECOND-HAND DEALERS AND PAWNSHOPS.
   (A)   Definitions. For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      DEMOLISHER. Anyone who engages in the business of converting motor vehicles into processed scrap or scrap metal or of otherwise wrecking or dismantling motor vehicles.
      JUNK DEALER. Anyone who engages in the business of buying, selling, trading or otherwise dealing in new or used scrap materials, including ferrous and nonferrous metal, brass, waste material and the like.
      SCRAP MATERIALS. New or used iron, steel or nonferrous metallic scrap, brass, waste material and any of the following materials or parts of said materials or any combination thereof: used and/or inoperative household appliances, household electrical or plumbing fixtures, floor coverings and/or window coverings; used lumber, brick, cement block, wire, tubing and pipe, tubs, drums, barrels and/or roofing material; air conditioning and heating equipment not currently in use; wrecked and/or junked vehicles; used vehicle components and parts; used furniture other than that designed for outdoor use or that which would normally be considered as antique furniture; inoperative residential lawn care equipment and machinery; used pallets; used windows and doors; new or used sheet metal, structural steel and/or chain; used and/or inoperative vending machines, radios and/or televisions; and inoperable machinery or equipment.
      SCRAP METAL PROCESSOR. Anyone who, from a fixed location, engages in the business of utilizing machinery or equipment, including wrecked or junked vehicles, for the processing of or manufacturing of iron, steel or nonferrous metallic scrap and whose principal product is scrap iron, scrap steel or nonferrous metallic scrap for remelting purposes.
      SECOND-HAND DEALER. Anyone who engages in the business of buying, selling, trading or otherwise dealing exclusively in: used books, magazines and other printed documents; used phonographic records, magnetic audio tapes, audio discs or other recordings of sound which do not include recordings of visual images; and/or used items of clothing; but not in any other items, goods, products, wares or articles which are subject to regulation under this subchapter.
      USED. Any items, goods, products, wares, chattels or articles of any sort which have previously been owned by someone other than the manufacturer or a dealer whose business it is to sell such items, goods, products, wares, chattels or articles when new to the consumer.
   (B)   Application. This subchapter shall not apply to new or used equipment, machinery and/or implement dealers not engaging in the business of buying, selling, trading or otherwise dealing in new or used scrap materials, as defined herein; or to businesses licensed and/or defined by this section, other sections of this code and/or state law as new or used automobile dealers, secondhand dealers or pawnshops. Nor shall this subchapter apply to anyone who engages in the business of buying, selling, trading or otherwise dealing in used items or scrap materials, as defined herein, and who conducts such business from within a wholly enclosed building or structure with no ongoing or permanent outside storage or display of such used items or scrap materials.
