§ 100.08 SERVICE FEES FOR RESPONSES TO EXCESSIVE FALSE ALARMS.
   (A)   An alarm site with less than 500 heat and/or smoke sensing devices is allowed four false alarms in a 12-month period. An alarm site with more than 500 heat and/or smoke sensing devices is allowed eight false alarms in a 12-month period. The alarm user shall be subject to a fee for responses to false alarms in excess of four in a calendar year.
   (B)   The fees are:
      (1)   False fire alarms: $150.00 per false alarm response after four or eight, depending on the number of heat/smoke sensing devices a facility has in a calendar year.
      (2)   False police alarms: $50.00 per false alarm response after four in a calendar year.
   (C)   Upon each response to a false alarm the fire department or police department personnel will complete a duplicate written notice. A copy of the written notice will be given to the alarm system user with a notation of the number of false alarm responses made to the location. The original notice will be maintained at the Police Department Communications Center. The notice will state the number of false alarms that have occurred in the current calendar year, the violation and the fee associated with violation when applicable.
   (D)   Upon response to the fifth or ninth false alarm, depending on the number of heat/smoke sensing devices a facility has, a letter will be sent to the location stating the violation and the appropriate assessed fee.
   (E)   The fee shall be paid within 15 days after notice of the imposition of the service fee, unless the service fee is appealed as provided for in § 100.10.
