§ 98.028 FEE FOR ISSUANCE OF PERMIT.
   A fee equal to a minimum of $250.00 or $20.00 multiplied by the square yardage of the surface area of the street or alley which will have to be restored as a result of the excavation or pavement cut shall be charged for the issuance of a street excavation permit to cover the city’s cost of restoring the street or alley surface. No fee shall be charged for the issuance of a street excavation permit to excavate or cut an unimproved or unpaved street or alley. Restoration of an asphalt, concrete or brick paved surface shall be done, or caused to be done, by the city; however, the person, firm or organization making the excavation or cut shall be responsible for proper backfilling of the excavation or cut and replacement of base material in accordance with the provisions hereof. No fee shall be charged for the issuance of a street excavation permit to tunnel, bore or jack under an improved or unimproved street or alley. Additionally, in instances where utilities are required to be relocated due to city, state or federal street or highway construction or reconstruction projects and where existing street or highway surfaces will be reconstructed or replaced as a part of such projects, the City Manager may waive the fees for issuance of street excavation permits required for the relocation of such utilities.
