(A) Beer and wine retail sales and holding an alcoholic beverage permit issued by the City Secretary of the City of Mount Pleasant will be allowed to operate only in areas that are zoned "HI" Heavy Industrial District, "LI" Light Industrial District, "C" Commercial District, "CB" Central Business District, "GR" General Retail District, and "NS" Neighborhood Services District. Zoning requirements and restrictions shall be enforced concerning the location of retail and/or wholesale outlets that provide and/or promote alcohol sales.
(B) Package store retail sales and holding an alcoholic beverage permit issued by the City Secretary of the City of Mount Pleasant will be allowed to operate only in areas that are zoned "HI" Heavy Industrial District, "LI" Light Industrial District, "C" Commercial District, "CB" Central Business District, and "GR" General Retail District. Zoning requirements and restrictions shall be enforced concerning the location of retail and/or wholesale outlets that provide and/or promote alcohol sales.
(C) The sale of alcoholic beverages for on-premise consumption shall only be permitted by restaurants or hotels/motels holding a food and beverage certificate and the restaurant's or hotel/motel's revenue from sale of alcoholic beverages shall be less than 40% percent of its gross revenue, or in compliance with current regulations of the Texas Alcoholic Beverage Commission or any successor agency.
(D) The sale of alcoholic beverages for off-premises consumption for beer and wine shall only be permitted by convenience centers that derive 40% or more of their gross revenue from the sale of non-alcoholic products and package stores.
(E) Mixed beverage sales for on-premises consumption will be allowed to operate only in areas that are zoned "PD" Planned Development District, "HI" Heavy Industrial District, "LI" Light Industrial District, "C" Commercial District, "CB" Central Business District, "GR" General Retail District, and "NS" Neighborhood Services District. Zoning requirements and restrictions shall be enforced concerning the location of retail and/or wholesale outlets that provide and/or promote alcohol sales to the extent that such requirements and/or restrictions do not violate the laws of the state or the rules and regulations of the Texas Alcoholic Beverage Commission as they may currently exist or in the future be enacted.
(F) Any business existing or new that desires to sell any alcoholic beverage within the city limits of the city must obtain an alcoholic beverage permit issued by the city.
