(A) The towing contractor shall have the sole responsibility for properly vetting, hiring and training of all tow truck operators/drivers. Each driver must hold valid South Carolina driver's license and be insurable. The towing contractor shall provide to the Town Police Department the full name, date of birth, and driver's license number of each employed driver at the time of application or upon hiring of a new driver within ten days of employment.
(B) The towing contractor shall not allow any of its operators/drivers to conduct business on behalf of the town's rotational system if they have been convicted of any felonies and/or serious misdemeanors within a ten-year period that include, but are not limited to, driving under the influence, theft, or assault.
(C) The towing contractor shall be responsible to make sure that all drivers are insurable so the towing contractor's insurance companies may not deny any insurance coverage due to the employment of anything but the most highly competent vehicle drivers who shall remain neat, clean, courteous, and sober while operating towing vehicles or responding to towing calls. The towing contractor agrees to be responsible for all drivers and take all steps necessary to ensure their compliance with this chapter.
(D) The Town Police Department reserves the right to limit or restrict certain operators/drivers, representing any towing contractor from responding to calls within the town based on his or her driving record, criminal history, or performance with the town.
(E) A driver/operator may only be employed with and operate for one towing contractor on the town's rotational system at any given time.
