For the purposes of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
LOBBYING.
(1) Promoting or opposing through direct communication with Town Council members:
(a) The introduction or enactment of an ordinance or resolution; or
(b) The awarding of a town contract.
(2) LOBBYING does not include the activities of a member of Town Council, town staff or any public official with regard to their public duties.
LOBBYIST.
(1) A person who is employed or retained, with compensation, by another person, governmental agency, a not-for-profit corporation, or private company for the sole purpose of lobbying a member of Town Council.
(2) LOBBYIST does not include:
(a) An individual who expresses a personal opinion, or discusses a constituent matter in relation to town services, or any other matter in which that individual is not receiving compensation to lobby.
(b) An individual who is a full-time, permanent employee of a governmental agency, a not-for-profit corporation, or a private company and is lobbying as a result of his or her employment.
