§ 75.03 PROHIBITED ACTIVITY IN THE PEDESTRIAN/BICYCLE WALKWAY.
   (A)   The use of all motorized vehicles, skateboards, in-line skates, or any like devices (except electric wheel chairs or other devices used by handicapped persons or vehicles used for official business) is prohibited on the pedestrian walkway of the Ben Sawyer Bridge.
   (B)   (1)   All town police officers having jurisdiction on the Ben Sawyer Bridge have the authority to confiscate any motorized vehicle, skateboard, in-line skates, or like devices used in violation of this chapter and deliver same to the Chief of Police. Upon the first offense, the Chief may return the device to the parents or legal guardian of such offender who is under the age of 17 years, in the event that a parent or guardian personally appears before the Chief and requests the return of the item within 10 days after notice is mailed to the parent or legal guardian that his or her child or ward has violated this regulation. If such request is not made, the item will be destroyed or sold at auction after 90 days from the date of mailing.
      (2)   On the second or subsequent offense within one year by the same person, the Chief shall confiscate the item and order it to be destroyed or sold at auction.
      (3)   Any person 17 years or older found to be acting in violation of this chapter shall be charged pursuant to § 75.99.
   (C)   Any activity that impedes the pedestrian and bicycle traffic flow on the Ben Sawyer pedestrian/bicycle walkway is prohibited.
