§ 51.018 PENALTY.
   (A)   A violation of any provision of this chapter, or failure to comply with any of its requirements, shall constitute a misdemeanor. Every person who violates any of the provisions hereof, or who fails to comply with any of the requirements hereof, shall, upon conviction thereof, be subject to a fine not to exceed $500, or imprisonment up to 30 days, or both. A separate offense shall be deemed committed on each day that a violation occurs or continues. No penalty hereunder shall exceed the penalty provided by state law.
   (B)   In addition to division (A), any violator hereunder shall be responsible to pay all costs and expenses involved in the case. Costs shall include the cost of cleanup associated with the illegal activities if the responsible party does not perform same, along with being responsible for any fines the town or the Commission might incur for the illegal activities. Nothing contained herein shall prevent the town or Commission from taking such other lawful actions as is necessary to prevent any violation.
