On any arrest being made by any police officer, such arrest shall be communicated immediately to the municipal judge or a magistrate for instruction, and until the police officer receives such instruction the party arrested shall be detained in custody, unless such deposit of money is made with the Clerk of Court as will be required for his or her appearance before the municipal judge or magistrate to answer the charges preferred against him or her.
