§ 51.06 DRAINAGE PROBLEMS AND PROCEDURE FOR REQUESTING RELIEF.
   (A)   Any person seeking relief from a drainage problem on private property shall present such in the form of a letter to the City Manager, who shall then present the request to the City Council at the next regular meeting of the Council.
   (B)   The person seeking relief from a drainage problem shall present to the City Manager, along with his or her letter requesting such relief, a signed, sworn and notarized statement from all property owners whose property may be affected by such relief, that such relief will not adversely affect their property, and a covenant not to sue the city for damages resulting from the requested relief. It shall be in the discretion of the city as to which property owners might be affected.
   (C)   (1)   The City Council shall study the request. If a majority of the City Council approves the request and finds that it is feasible, the work shall be done, and the city shall provide all labor, and the owner or owners shall pay all of the costs of materials and shall provide the city a right-of-way or easement of not less than ten feet in width which shall extend to a point at least five feet past each side of the proposed construction.
      (2)   Such construction shall at all times comply with the requirements set forth by the City Manager; such materials used thereon shall meet the specifications set forth by the City Manager.
