§ 153.010 GENERAL DEFINITIONS.
   (A)   (1)   Words used in the present tense shall include the future tense;
      (2)   Words used in the singular shall include the plural, and words used in the plural shall include the singular;
      (3)   The words “shall” and “will” always indicate MANDATORY;
      (4)   The words “should” and “may” always indicate OPTIONAL;
      (5)   The word LOT includes the words “plot”, “tract” and/or “parcel;”
      (6)   The word BUILDING includes the word “structure;”
      (7)   The word PERSON includes a “firm, association, organization, partnership, trust, company, corporation and/or individual;” and
      (8)   The word USE includes the terms “arranged”, “designed” and/or “intended” for use, activity and/or purpose.
   (B)   For the purpose of this chapter, the following definitions apply unless the context clearly indicates or requires a different meaning.
      APPLICANT. A person who applies for subdivision or site plan approval.
      CONSTRUCTION PLAN. Plans detailing the manner a builder or contractor uses to make improvements to a property.
      DEDICATION. A gift, by the owner, of a right to use of land for a specified purpose or purposes. Because a transfer of property rights is entailed, DEDICATION must be made by written instrument, and is completed with an acceptance.
      EASEMENT. A grant of one or more of the property rights by the property owner of a portion of land for a specified purpose and use by the public, a corporation or other entities.
      LOT. A separate and distinct unit of land described by either a metes and bounds description and/or subdivision plat of record and/or probated will. LOT includes a portion of a subdivision or any other parcel of land, intended as a unit for transfer of ownership or for development of both.
         (a)   CORNER LOT. A lot abutting two or more streets at their intersection.
         (b)   REVERSE FRONTAGE LOT. A through lot which is not accessible from one of the parallel or non-intersecting streets upon which it fronts.
         (c)   THROUGH LOT. A lot abutting two streets that do not intersect at the corner of the lot.
      PLANNING COMMISSION. The Planning Commission of the City of Mount Holly, North Carolina.
      RESERVATION. An obligation, shown on a plat or site plan, to keep property free from development and available for public acquisition for a stated period of time. It is not a dedication or conveyance.
      RESERVE STRIP. A strip of land, usually only a few feet wide, owned privately, and set aside around a subdivision in order to prevent access to adjacent property by way of subdivision streets.
      SITE PLAN. A plan detailing the proposed improvements to a given lot.
      STORM, TEN-YEAR. The surface runoff resulting from a rainfall of an intensity expected to be equaled or exceeded, on the average, once in ten years, and a duration which will produce the maximum peak rate of runoff for the watershed of interest under average antecedent wetness conditions.
      STORM, 25-YEAR. The surface runoff resulting from rainfall of an intensity expected to be equaled or exceeded, on the average, once in 25 years, and a duration which will produce the maximum peak rate of runoff for the watershed of interest under average antecedent wetness conditions.
      STORM, 100-YEAR. The surface runoff resulting from rainfall of an intensity expected to be equaled or exceeded, on the average, once in 100 years, and a duration which will produce the maximum peak rate of runoff for the watershed of interest under average antecedent wetness conditions.
      SUBDIVIDER. A person engaging in the act of subdividing property.
      SUBDIVISION. See § 153.005.
      STREET. A public right-of-way for vehicular travel which has been constructed and then dedicated to and accepted by the city or the State Department of Transportation for public use, or which has been otherwise obtained by such agencies for such use, or which is proposed to be constructed and then dedicated to and accepted by such agencies as a public right-of-way for vehicular traffic for public use pursuant to this chapter.
      TERRITORIAL JURISDICTION. The city limits as now or may be hereafter established.
      THOROUGHFARE PLAN. The thoroughfare plan as adopted by the City Council and as may from time to time be amended.
