(A) The Enforcement Response Plan contains an Enforcement Response Guide (ERG) which outlines types of violations and specifies the city’s actions, both internal and escalated, timeframes, and the person(s) responsible for completing the actions. The city uses a tiered response approach geared to a six-month reporting period to enforce Chapter 52, however, for ongoing noncompliance and/or situations with severe impacts, the city will consider the user’s previous history, violations that occur but are not contained in this ERP will be evaluated on a case by case basis.
(B) Responses to violations that the city determines have or may:
(1) Affect the operation of the POTW;
(2) Cause adverse impact to the POTW;
(3) Result in interference;
(4) Result in inhibition;
(5) Result in pass through;
(6) Cause POTW, NPDES, collection system or other state and/or federally issued permit violations; or
(7) Result in environmental harm or endangerment to human health will be taken immediately following discovery.
(C) Certain cases may be referred to the state or federal government for possible criminal investigation and enforcement. Reference Chapter 52 for further guidance.
