(A) The water purveyor shall deny or discontinue, after reasonable notice to the occupants thereof, the water service to any premises wherein any backflow prevention assembly required by this chapter is not installed, tested and maintained in a manner acceptable to the water purveyor, or of it is found that the backflow prevention assembly has been removed or bypassed, or if an unprotected cross- connection exists on the premises.
(B) Water service to such premises shall not be restored until the consumer has corrected or eliminated such conditions or defects in conformance with this chapter to the satisfaction of the water purveyor.
(C) Civil penalty of $100 per day may be assessed to any penalty if deemed necessary by the Backflow ORC to bring any violation back into compliance.
(D) The Backflow ORC may increase any civil penalty assessed under this section by $100 or 50% of the maximum civil penalty associated with the violation, whichever is greater, for a second violation of the same provision within a two-year period. Water service may be terminated after a third violation of the same provision within a two-year period. All such expenses are deemed to be a part of the civil penalty assessed with the violation.
