§ 11-1-1 ALTERING BUILDING LOTS.
   (A)   It shall be unlawful for any person to fill, grade, level, transform or otherwise alter the terrain or topography of any parcel of real estate located within the corporate limits of the city, unless such activity is performed in accordance with a permit issued by the appropriate official of the city. Such permits shall be issued upon application by the owner of the premises to be affected by such filling, grading, leveling, transforming or otherwise altering, or the owner’s authorized agent.
   (B)   Permits shall be issued for such activity upon the showing of the need to conduct such activity to facilitate the construction of a structure for residential, commercial or industrial purposes, or upon the showing that such activity is for the purpose of alleviating flooding or promoting drainage in such a manner that it will enhance the value of the subject premises but not create an adverse impact or effect upon neighboring premises; or upon the showing that such alteration is temporary in nature to allow for the replacement or repair of underground water or sewer laterals or natural gas lines or other utilities.
