§ 7-3-2 PUBLIC INTOXICATION; CONSUMPTION IN PUBLIC PLACES.
   (A)   Public intoxication.
      (1)   It shall be unlawful for any person in any public place to be in such a state of intoxication that:
         (a)   He or she is unreasonably loud, obscene or disorderly so as to breach the peace; or
         (b)   He or she is incoherent, incapacitated or asleep so as not to be able to control, direct or protect himself or herself.
      (2)   It shall be the duty of police officers to arrest any such person when they reasonably believe such condition exists.
   (B)   Consumption in public places prohibited. It shall be unlawful for any person to consume or possess in any open container any alcoholic liquor in the public parks, streets, municipal buildings, alleys or highways, or other places of public assembly.
