§ 6-1-6 PART-TIME POLICE OFFICERS.
   (A)   The Mayor, subject to the approval of the City Council, may appoint, discipline and discharge part-time police officers in numbers adequate and necessary to provide police protection to the residents of the city. The Chief of Police shall compile a list of part-time police officers appointed by the Mayor and approved by the City Council. The Chief of Police shall be responsible for the assignment of part-time officers based upon the needs of the city. Such assignments shall be made at the discretion of the Chief of Police. The Chief of Police is authorized to discipline part-time officers up to, and including, the removal of a part-time officer from the list of appointed part-time officers thereby terminating the officer’s employment by the city.
   (B)   Part-time police officers shall be members of the regular Police Department. Part-time police officers shall not be eligible for any pension benefits available to regular full-time police officers.
   (C)   Part-time police officers shall not be assigned to supervise or direct the Department’s full-time officers, nor shall part-time police officers be used as permanent replacements for full-time police officers.
   (D)   Part-time police officers shall be trained under the Intergovernmental Law Enforcement Officer’s In-Service Training Act in accordance with the proceedings for part-time officers established by the state’s Law Enforcement Training Standards Board.
   (E)   Part-time officers to be employed by the city must meet the following requirements:
      (1)   Be a citizen of the United States of America;
      (2)   Have a valid diploma from high school;
      (3)   Have no record of criminal convictions and submit valid fingerprints to the state’s Bureau of Identification;
      (4)   Be a graduate of the State Police Academy, Police Training Institute or similar academic/recognized by the state’s Law Enforcement Training and Standards Board;
      (5)   Be in good standing with any police agency that the officer is or has been employed by;
      (6)   Qualify annually with their duty weapon and to file the results of such qualification, date of such qualification, and by which the officer was qualified;
      (7)   Attend and satisfactorily complete annual training in hazardous materials and all other training required by the city;
      (8)   All part-time officers shall take an oath of office administered by the City Clerk in the presence of the Mayor of the city;
      (9)   Part-time officers are employed as “at will” employees and their employment may be terminated at any time without cause and with any requirement for procedural or substance due process;
      (10)   Part-time officers shall familiarize themselves with the policies of the Police Department of the city and carry out their duties in accordance with those policies. They shall meet the same standards of performance as full-time officers including responding to calls for service, patrol duties, business checks and satisfactorily complete all necessary written reports and fulfill all other duties that might arise during their shifts. Part-time officers shall personally perform their duties without imposing upon other officers for the completion of those duties;
      (11)   Full-time officers are senior to part-time officers. Part-time officers shall accept direction from senior officers and adhere to the chain of command as delineated by the Chief of Police. Part-time officers may contact the Chief of Police for clarification of policy or directions or advice in the event that a full-time officer is not readily available. No part-time officer is to obey an order from a senior officer if the part-time officer reasonably believes that such order is not legal; and
      (12)   Part-time officers shall be responsible to cover the shifts for which they have volunteered or to which they have been assigned. If an officer is unable to cover his or her assigned shift due to illness or employment conflict, the officer shall immediately give notice to the Chief of Police or the officer on duty. If the part-time officer is unable to cover his or her assigned shift, he or she has the duty to find another officer to cover such shift unless other arrangements have been made with the Chief of Police. Failure to cover an assigned shift, or providing for coverage by another officer, shall be grounds for discipline.
