§ 6-1-2 POWERS AND DUTIES.
   The Chief of Police shall do and perform the following duties, together with such other powers and duties as are prescribed by the Mayor and Council from time to time or as set forth by city ordinance or state law.
   (A)   The Chief of Police shall be a conservator of the peace and is authorized and empowered to arrest or cause to be arrested, all persons who shall break the peace or be found violating any ordinance of the city, making such person liable to arrest, or any criminal law of this state; to commit for examination and if necessary detain such person in custody overnight or Sunday in the county jail or the city prison until such person can be brought before the proper court.
   (B)   He or she shall execute all processes issued by the proper court and shall perform all other duties properly coming within the scope of his or her office and necessary for the preservation of the public peace or the observance and enforcement of the ordinances of the city, and as are enjoined upon all constables by the statutes of this state. He or she shall make and present to the Mayor a semiannual report, verified by affidavit of all fees and emoluments received by him or her as such Chief of Police and of all the moneys received and collected by him or her, from any source in behalf of the city, and shall attach to said report receipts of the proper officers for all such moneys as he or she may receive or collect in behalf of the city.
   (C)   The Chief of Police shall have power to summon as many persons to his or her assistance as may be necessary to enforce the laws and ordinances.
   (D)   It shall be unlawful for the Chief of Police or any police officer of the city to willfully refuse or neglect to execute any writ or process placed in his or her hands for that purpose or to arrest any person known to have violated any law or ordinance of the city or to perform any other duty required of him or her by the ordinances of the city, or shall in the discharge of his or her official duties be guilty of any fraud, extortion, oppression, favoritism, partiality, bribery or willful wrong or injustice.
   (E)   The Chief of Police shall be ex officio superintendent of police and shall receive a fixed salary at time of appointment and will receive a $300 raise every six months until he or she has been employed by the city for a period of five years, at which time the Council will then decide upon an annual salary increase.
