(A) It shall be unlawful to burn any garbage, rubbish or yard waste in the city limits except as provided by the rules and regulations of the State Pollution Control Board, the current edition of which is adopted as the rules and regulations for open burning for the city.
(B) The burning of yard waste is allowed, subject to the following restrictions.
(1) No burning shall commence prior to 8:00 a.m. nor shall it be allowed later than sunset.
(2) No burning of yard waste is allowed if wind speeds exceed ten mph.
(3) The burning of yard waste must stop immediately if directed by the Fire or Police Departments of the city.
(4) No substance shall be burned other than yard waste, pursuant to this chapter.
(5) All burning must be supervised.
(C) No commercial establishment or resident in the city shall cause, suffer or permit open burning of trash except as provided in this chapter and except as conforms to the rules and regulations established by this code.
(D) No burning of any nature is allowed within the following boundaries:
(1) Carroll Creek on the north;
(2) Clay Street on the east;
(3) Mill Street on the west; and
(4) Rapp Street on the south.
