§ 4-7-7 VIOLATIONS; PENALTY.
   (A)   (1)   The penalty for § 4-7-5(A)(1)(a), (B), (C) and (D) shall be a fine of not less than $50 nor more than $500. Where an offense is ongoing and permitted to continue, each day shall constitute a separate offense.
      (2)   Violations with respect to purchase of tobacco products (§ 4-7-5(A)(2)), and/or possession of tobacco products (§ 4-7-5(A)(3)), by a person under the age of 18 years, shall have the following penalties. Where an offense is ongoing and permitted to continue, each day shall constitute a separate offense.
 
Violation of purchasing tobacco products (§ 4-7-5(A)(2))

      (3)   First time offenders have the option of attending a free smokers education class presented by the County Health Department in lieu of paying a fine. The hours and duration of the class will be established by the Health Department.
   (B)   The penalty for § 4-7-3(A) shall be a fine of not less than $50 nor more than $500. Where an offense is ongoing and permitted to continue, each day shall constitute a separate offense.
