All owners of residential premises in the village shall subscribe to, and be a customer of, the licensee for refuse removal for the residential area containing the premises, as described herein, and it shall be unlawful, and a violation of this section, for any such owner to fail at any time to be fully and lawfully entitled to receive refuse removal service from such licensee. It shall be a defense to any prosecution for a violation hereof that the licensee from whom the property owner is required to receive service has failed to provide such service in material breach of the provisions of this chapter or any other applicable law or ordinance, or in material breach of any lawful agreement between the owner and licensee.
