§ 10.99  GENERAL PENALTY.
   (A)   Penalty.
      (1) Any person convicted of a violation of any section of this code shall be fined not less than $75 nor more than $750 for any one offense.
      (2)   Any minor or person designated a juvenile by this state convicted of a violation of any section of this code shall be fined not less than $75 nor more than $750 for any one offense, but may not be confined except by provisions of the Juvenile Court Act of the state, being 705 ILCS 405.
      (3)   Whoever commits an offense against the village or aids, abets, counsels, commands, induces or procures its commission is punishable as a principal.
      (4)   Whoever willfully causes an act to be done which, if directly performed by him, her or another would be an offense against the village, is punishable as a principal.
      (5)   All municipal ordinance offenses may be satisfied without a court appearance by written plea of guilty and payment of the minimum fine, plus court costs, unless a court appearance is required by the ordinance violated.
      (6)   Community service: a penalty imposed for the violation of any section of this code may include, or consist of, a requirement that the defendant perform some reasonable public service work such as, but not limited to, the picking up of litter in public parks or along public highways or the maintenance of public facilities.
      (7)   In addition to any penalties specified under this division (A), the village may request from a court of competent jurisdiction any equitable or injunctive relief necessary to aid in the enforcement of its ordinances and may request a court of competent jurisdiction, to enter an order requiring any person convicted of a violation of the code, to refrain from further violation.

   (B)   Minor violations. The tickets issued under this section shall be as a courtesy in lieu of arrest. If the person accused of this violation does not settle the claim, a complaint or notice to appear will be issued for that violation and the person shall be subject to the penalties set forth in division (A) above.

   (C)   Service by certified mail. In all actions for violation of any municipal ordinance where the fine would not be in excess of $750 and no jail term could be imposed, service of summons may be made by the Municipal Clerk by certified mail, return receipt requested, whether service is to be within or without the state.

   (D)   Application.
      (1)   The penalty provided in this section shall be applicable to every section of this village code, the same as though it were a part of each and every separate section. Any person convicted of a violation of any section of this village code, where any duty is prescribed or obligation imposed, or where any act which is of a continuing nature or declared to be unlawful, shall be deemed guilty of a misdemeanor. A separate offense shall be deemed committed upon each day such duty or obligation remains unperformed or such act continues, unless otherwise specifically provided in this village code.
      (2)   In all cases where the same offense is made punishable or is created by different clauses or sections of this village code, the prosecuting officer may elect under which to proceed; but not more than one recovery shall be had against the same person for the same offense; provided that the revocation of a license or permit shall not be considered a recovery or penalty so as to bar any other penalty being enforced.
      (3)   Whenever the doing of any act or the omission to do any act constitutes a breach of any section or provision of this village code, and there shall be no fine or penalty specifically declared for such breach, the provisions of this code shall apply and a separate offense shall be deemed committed upon each day during or on which a breach or violation occurs or continues.
