(A) The owner of all houses, buildings or properties used for human occupancy, employment, recreation, or other purpose, situated within the City and abutting on any street, alley, or right-of-way in which there is now located or may in the future be located, a public sanitary sewer of the City, is hereby required, at his expense, to install suitable toilet facilities therein, and to connect such facilities directly with the proper public sewer in accordance with the provisions of this ordinance, within 60 days after date of official notice to do so, provided that said public sewer is within 200 feet of the property line.
(B) All structures in the City of Mt Vernon shall have a backflow prevention “Backwater Valve” to eliminate potential flooding of the premises with sewage. Further, all such valves shall be the sole responsibility of the owner to install and maintain in working order. The City of Mt. Vernon shall not be responsible for the installation or operation of Backwater Valves, nor for damage caused by sewerage backflow.
(C) When a new sewer main is installed in a previously unserved areas within the corporate limits of the City of Mt. Vernon, each residential, commercial, and industrial building or other building having or requiring sewer facilities located on, or accessible to such main, shall within 90 days connect to the main at the owners expense and shall be subject to all new connection permits, rules and fees.
(D) In the event that the City shall hereafter determine, and the City Council of the City of Mt. Vernon shall provide by resolution or ordinance, that capacity is not available for new sewer connections in the sewers, lift stations, and treatment plant of the City, then and in that event, connection to a public sanitary sewer of the City is not required, as provided herein, during such time as such determination shall remain in effect. In the event that a public sewer thereafter becomes available in the future, said property shall to connect to the City sewer at the owner’s expense in accordance with this ordinance within 90 days from written notice from City to connect.
