3-4-6: INAPPROPRIATE PARK CONDUCT AND PROHIBITED ACTIVITIES:
The following activities shall be prohibited in all public parks:
   A.   Disfiguration, Damage, Modification And Removal Of The Built Environment: Willfully mark, deface, disfigure, injure, tamper with, damage, displace or remove, any building, bridges, tables, benches, fireplaces, railings, paving or paving material, water lines or other public utilities or parts or appurtenances thereof, signs, notices, or placards whether temporary or permanent, monuments, stakes, posts, or other boundary markers, or other structures or equipment, facilities or park property or appurtenances whatsoever, either real or personal 1 .
      1.   It is prohibited for any person to construct or erect any building or structure of whatever kind, whether permanent or temporary in character, or run or string any public service utility into, upon or across any City park.
      2.   Advertising Or Signage In Parks: It is prohibited for any person to paste, glue, tack or otherwise post any signs, plaques, advertisements or inscriptions whatsoever in any park, including adjacent rights of way (sidewalks, parking lots, etc.), except plaques, tablets or signs, of a size, design and location approved by the Park Superintendent or their designated representative, recognizing or acknowledging donations or contributions to any City park or to public facilities therein.
   B.   Restrooms And Washrooms: No person shall fail to cooperate in maintaining restrooms and washrooms in a neat and sanitary condition.
   C.   Removal/Disruption/Damage Of Natural Resources: Dig, or remove any soil, rock, stones, trees, shrubs or plants, wood, or materials, or make any excavation by tool, equipment, blasting, or other means.
      1.   Trees, Shrubbery And Lawns: Damage, cut, carve, transplant, or remove any tree or plant, injure the bark, or pick the flowers or seeds, of any tree or plant. Nor shall any person attach any rope, wire, or other contrivance to any tree or plant. A person shall not dig in or otherwise disturb grass areas, or in any other way injure or impair the natural beauty or usefulness of any area except by approval by the Park Superintendent or their designated representative.
      2.   Pollution Of Waters: Throw, discharge, or otherwise place or cause to be placed in the waters of any pond, lake, stream, or other body of water in or adjacent to any park or any tributary, stream any substance, matter or thing, liquid or solid, which will or may result in the pollution of said waters.
   D.   Glass Containers Prohibited: It is prohibited for any person to throw, carry, or have in their possession any glass beverage container on City park grounds which includes the interior of athletic complexes unless approved with a special event.
   E.   Operation Of Vehicles: No motorized vehicle in any park area except the paved public park roads designated for motor vehicles or parking areas, or such other areas as may on occasion be specially designated by municipal authorities. This rule shall not prohibit the use of ADA compliant wheelchairs that are motorized and other similar accessibility enhancing devices by a disabled individual.
      1.   Parking: Parking a vehicle in other than an established or designated parking area, and such use shall be in accordance with posted directions thereat and with instructions of any municipal officer who may be present. Authority to remove vehicles parked on grass if unable to find owner set forth in section 6-4-8.
   F.   Alcoholic Beverages: No person shall consume any alcoholic beverage or controlled substances as defined by state code or have in his possession any opened containers or receptacles containing any alcoholic beverage on any public park grounds, or thoroughfares within the City, or at any other place therein, other than a private residence or upon premises licensed for the sale and consumption of alcoholic beverages or upon premises whereon alcoholic beverages are sold by a licensee under an Idaho liquor catering permit, as authorized by law.
      1.   All park reservations and special events are excluded as well as City owned golf courses and adjacent grounds are excluded from this section.
   G.   Commercial Activities In Parks:
      1.   Sale Of Food Or Goods: No person shall sell any goods, food or food product of any kind in any City park (except for licensed mobile food concessions in the designated area of the El Rancho Parking Lot and Rail Road Park), including adjacent rights of way (sidewalks, parking lots, etc.), without an approved Special Event.
      2.   Vehicle Sales: It shall be unlawful to park or display "for sale vehicles" within the boundaries of a public park, public park parking lot, trail way or trail way parking lot. The Parks and Recreation Department may have violating vehicles towed at owner's expense. See also section 6-4-8.
   H.   Recreational Activities:
      1.   Amusement Equipment: Inflatable bounce houses or similar devices are prohibited without a park reservation or a special event.
      2.   Barbecuing: Barbecuing is allowed if steps are taken to ensure it won't cause damage to surrounding grass, trees, structures, etc. and that grease is contained and removed from City park property.
      3.   Camping: Overnight camping is prohibited in City parks and other public property without the written approval of the parks or recreation superintendent or designated representative.
      4.   Hunting is prohibited in public parks.
         a.   This excludes fishing.
         b.   Including giving, offering, or attempting to give any animal or bird any tobacco, alcohol, poison, or other harmful substance.
      5.   Projectiles: The participation in any activity involving dangerous objects such as stones, arrows, or javelins, except in areas set apart for such forms of recreation by the Parks Superintendent is prohibited.
      6.   Discharge of firearms and/or fireworks shall be prohibited in public parks with exception of City functions.
         a.   Fireworks In Legacy Park Exception: The Park Superintendent or their designated representative may designate an area of Legacy Park for 4th of July celebration.
      7.   Fires: No person (unless designated by the City) shall build or attempt to build a fire. No person shall drop, throw, or otherwise scatter lighted matches, burning cigarettes or cigars, tobacco paper, or other inflammable material, within any park area or on any highway, road, or street abutting or contiguous thereto.
      8.   Golf Activities Prohibited: No person shall engage in, or attempt to engage in, any type of golf activity, whether putting, driving, chipping, swinging, or any other golf related activity in any City park
      9.   Metal Detecting: Metal detecting within a cemetery or upon a golf course is prohibited and any person who is using or attempting to use a metal detector or similar device within a cemetery or upon a golf course shall be issued an infraction.
         a.   Any person who is using or attempting to use a metal detector or similar device in a park shall be issued an infraction unless that person has a current permit for metal detecting issued by the City of Mountain Home Department of Parks and Recreation.
