7-7-10: VARIANCE; APPLICATION, PUBLIC HEARING REQUIRED:
Any person who owns or is in possession of any property or use, or any process or equipment, may apply to the city council for a variance from the requirements of this chapter or the rules promulgated hereunder. The city council may grant a variance if there is a finding that: a) the sound occurring or proposed to occur does not endanger public health or safety, and b) the owners or possessors of property in the area of the sound will not be unreasonably adversely affected. Variances may only be granted after a public hearing on the proposed variance and may be granted for any period of time at the discretion of the city council, said hearing to be conducted in accordance with section 1-10-1 of this code.
