713.05 SUSPENSION OR CANCELLATION OF PERMIT.
   (a)   In the event of violation of a condition, limitation or restriction imposed in the granting of any permit herein provided for, or in the event of the misapplication of any funds collected thereunder, or upon the discovery of fraud or misrepresentation committed by the permittee or his agents in connection with the application or the solicitation, Council may by a majority vote of its members at a regular meeting, a special meeting or by a telephone poll of votes conducted by the City Clerk, suspend the effectiveness of the permit pending a hearing before it at a regular Council meeting, as to whether such permit has been violated. Such suspension of the permit shall be in effect only until the hearing before Council, upon reasonable notice, at which hearing the holder of the permit may appear before Council in person or by counsel, and may produce evidence.
   (b)   Council is hereby authorized to hear testimony and swear witnesses, and the Police Judge is hereby authorized to issue subpoenas duces tecum upon application therefor and proper showing being made by Council, such subpoenas to be served by any police officer of the City. If, upon the hearing, Council determines that this article has been violated, or any condition, limitation or restriction imposed in any permit has been violated, Council may cancel the permit or may suspend the effectiveness thereof for such time as Council may deem advisable. Council shall make a written finding of the facts, based upon the testimony heard by it, and its findings as to the facts shall be conclusive. If Council, after hearing, determines that the permit was not violated, then it shall renew the permit to extend its life until such day designated by Council.
