No person shall engage in the operation of a massage parlor as a masseur within the meaning of this article without securing a permit from the Director of Finance in accordance with the provisions established herein. Nothing in this article shall be construed as applying to licensed practical nurses, orderlies, attendants or nurses aides working in hospitals, nursing homes and other establishments who are under the direction, control and supervision of a licensed practicing physician. This article shall also not apply to massage therapists who are licensed by the West Virginia Massage Therapy Licensure Board.
