When a law enforcement officer issues a summons or ticket for a violation under this article the officer may impound the "motorized recreational apparatus" used in violation of this article. Upon presentation of proper identification, the owner or operator may reclaim the vehicle at any time subsequent to twenty-four (24) hours after the impoundment, upon payment of any and all costs associated with the impoundment. In the event that the owner/operator of the vehicle is exonerated before the Municipal Court Judge, all costs of impoundment shall be reimbursed by the City to the owner/operator.
