347.01 OVERSIZE OR OVERWEIGHT VEHICLES.
   (a)    Use of State Routes in Municipality. It shall be unlawful for any owner, operator, lessee, or borrower of a vehicle or combination of vehicles to operate or permit to be operated, on any state route within the City, such vehicle or combination thereof, of a size, weight, or load exceeding the maximum specified in West Va. Code, Chapter 17C, Article 17 (§ 17C-17-1 et seq.), except pursuant to special written permit issued by the Commissioner of Highways.
   (b)    Use of Local Streets. It shall be unlawful for any owner, operator, lessee, or borrower of a vehicle or combination of vehicles to operate or permit to be operated, on any street, alley, or way within the City which is not designated as a truck route, such vehicle or combination thereof in excess of 10,000 pounds gross weight, loaded or unloaded.
   (c)    Use of Truck Routes. All vehicles commercial or private, exceeding 10,000 pounds of gross weight, loaded or unloaded, are prohibited from being operated upon the streets, alleys, and rights of way of the City, except upon those streets, alleys or rights of way designated herein as truck routes. On such City streets designated as truck routes which are not also state routes, it shall be unlawful for any owner, operator, lessee, or borrower of a vehicle or combination of vehicles to operate or permit to be operated thereon, such vehicle or combination thereof in excess of 20,000 pounds gross weight, loaded or unloaded.
   (d)    All such truck routes shall be properly posted with appropriate signs with nationally recognized symbols that notify vehicle operators that operation of such vehicles is prohibited on said streets, alleys, and rights of way except for those designated as truck routes. Those streets, alleys, and rights of way within the City of Moundsville to be designated as truck routes are as
follows:
      (1)    Jefferson Avenue Extension from West Virginia Route 2 to its intersection with First Street.
      (2)    First Street from its intersection with Jefferson Avenue, eastward to the City Limits.
      (3)    Jefferson Avenue from the intersection of First Street and Jefferson Avenue, southward to the intersection of Jefferson Avenue and Seventh Street.
      (4)    Seventh Street from the intersection of Seventh Street and Jefferson Avenue, westward to the intersection of Seventh Street and West Virginia Route 2.
      (5)    Twelfth Street from the intersection of Twelfth Street and West Virginia Route 2 eastward to the City Limits.
      (6)    Fourth Street from the intersection of Fourth Street and Grant Avenue eastward to the City Limits.
      (7)    Poplar Avenue from the intersection of First Street and Poplar Avenue southward to the intersection of Fourth Street and Poplar Avenue.
      (8)    Grant Avenue from the intersection of First Street and Grant Avenue southward to the intersection of Grant Avenue and Fourth Street.
      (9)    All of West Virginia State Route 2 within the corporate limits of the City of Moundsville.
      (10)    Cedar Avenue from the intersection of First Street and Cedar Avenue southward to the intersection of Cedar Avenue and Fourth Street.
   (e)    The City Manager shall have the authority to erect whatever signs he deems necessary to give notice of the provisions of this section.
   (f)   The City Manager shall have authority to issue a permit for "occasional passage" for vehicles in excess of the size and load limits prescribed in this section, and such permit shall be in writing and shall specify the route and shall be good only for one day.
   Any person operating a vehicle under such permit shall pay to the City the amount of any and all damages that may be caused to any street, alley or bridge by reason of the operation of such vehicle thereon, and the possession of such permit shall not relieve any person from the liability for such damage.
   (g)    No person shall park any truck, tractor trailer, or other tandem vehicle, van, motor home, or camper on any street or right of way of the City except for the purpose of unloading or loading of such vehicle, and only for the actual period of time expended in such unloading or loading. For the purpose of this subsection, "truck" and "van" shall not include such vehicles weighing three-fourths of a ton or less. (Ord. 11-3-10.)
