(a) The Arts and Culture Commission shall consist of nine (9) members who shall be appointed by Council without regard to their political affiliations, but with regard to their knowledge, experience, abilities, and/or interest relating to the subject of art and cultural matters. Seven (7) members shall be residents of the City of Moundsville or be a representative of an entity which operates in the City of Moundsville, and two (2) members shall be members of City Council.
(b) The Council members shall be appointed until replaced by City Council or until the member ceases to be a City Council member. Other Commission members shall be appointed for a six (6) year term, provided that as to the first such appointed members, one shall be appointed for a two (2) year term, one for a four (4) year term, and one for a six (6) year term, so as to provide for staggered expirations of terms. The date upon which the terms of the first such Commission members are to commence shall be the 1st day of July, 2020. (When this article was originally adopted it provided for five (5) members. In April of 2021, an additional two (2) members were added. The said two (2) new members shall serve six (6) year terms to commence on the 1st day of July, 2021).
(c) In the event a member of this Commission is absent from regularly scheduled or specially called meetings for more than fifty percent (50%) of the time during any calendar year, that member shall be deemed to have vacated his or her position on the Commission, unless City Council shall affirmatively approve of the absences for good cause.
(d) When any vacancy occurs on the Commission before the expiration of the term of that member, excepting as to a Council member thereof, by reason of death, resignation, change of residence or other cause, the Commission shall appoint a successor to serve until the expiration of the term. The Commission's appointment is subject to the approval of the City Council. When any vacancy shall occur on the Commission with respect to a Council member thereof, such vacancy shall be filled by the City Council.
