151.03 NOTICE OF HEARINGS; DEPOSIT.
   (a)   In addition to any notice requirements imposed by West Virginia Code Article 8-24, due notice of any hearing to be held by the Planning Commission shall also be given to all interested parties at least fifteen days prior to the date of any such hearing. Such notice shall be given by sending the same to the interested parties by certified mail at their last known address, and "interested parties" means any person or entity owning property within 200 feet of the affected area.
   (b)   The petitioner, applicant or any other such person, firm, or corporation requesting such hearing before the Planning Commission shall deposit the sum of one hundred dollars ($100.00) with the Commission to defray costs of public notice and the notice to interested parties as described in subsection (a) hereof. Any excess funds from said deposit after payment of said notices, shall be retained by the City Treasurer to defray miscellaneous administrative costs in conjunction with such hearing. (Ord. 11-1-94)
