Private swimming pools are permitted accessory uses only when located in rear yards, and when completely enclosed with a protective barrier at least four (4) feet in height to protect persons or animals from trespassing and to assure that they are not subject to danger or harm. All openings in the barrier shall be equipped with gates or doors that shall be securely closed when not in use. Such swimming pools shall be considered accessory uses in all districts. For the purpose of this section, "swimming pools" refer to any structure intended for swimming or recreational bathing, that is capable of containing water over twenty-four (24) inches deep, including in-ground, above-ground, and on-ground swimming pools, hot tubs, and spas. Swimming pools and protective barriers must adhere to setback requirements within the zoning district where the pool is to be located. (Passed 10-3-17.)
