1713.02 VARIANCES.
   (a)   Council, when so appealed to and after a public hearing, may vary the application of any provision of the Building and Housing Code relating to building restrictions and prohibitions when, in its opinion, the enforcement thereof would do manifest injustice, and would be contrary to the spirit and the purpose of this Code or public interest.
   (b)   A decision of Council to vary the application of any such provision of this Code shall specify in what manner such variation or modification is made, the conditions upon which it is made, and the reasons therefor.
   (c)   In granting such modifications and variations Council shall consider the following criteria:
      (1)   The improvement to the existing structure;
      (2)   The positive and negative impact on adjoining properties;
      (3)   The positive and negative impact on the character and aesthetics of the area.
   (d)   The modification or variation if authorized, shall represent the minimum variance that will afford relief and will represent the least modification possible of the regulation in issue.
