1311.04 PROCEDURE FOR PRELIMINARY PLAT REVIEW.
   (a)   Application. On reaching conclusions as recommended above regarding the preapplication plat, the subdivider shall prepare and submit to the City Manager at least ten days prior to the regular monthly meeting of the Planning Commission, four copies of the preliminary plat of the total land to be ultimately developed for review by the Commission according to the requirements and regulations contained herein.
 
   (b)   Action by City Engineer. The City Manager upon receipt of the copies of the preliminary plat shall transmit one copy to the City Engineer. The City Engineer shall determine if the proposed preliminary plat conforms with the requirements of the Land Subdivision Regulations and shall report his findings in writing to the Commission at their next meeting.
 
   (c)   Review by Planning Commission. At the first regular meeting of the Commission following receipt of the preliminary plat the Commission shall review the plat and other materials submitted for conformity to these Regulations, incorporating the report from the City Engineer. The Commission shall advise the subdivider on changes deemed advisable and the kind and extent of improvements to be made by him.
 
   (d)   Action by Planning Commission. Within forty days of the first meeting at which the preliminary plat was considered, the Commission shall notify the subdivider of the scheduled meeting place, date, time and agenda schedule at which the preliminary plat shall be acted thereon as submitted, or modified. If approved, the Commission shall express its approval by resolution as conditional approval and state the conditions of such approval, if any; or if disapproved shall express its disapproval by resolution and its reasons thereof. The action of the Commission shall be noted on the copies of the preliminary plat, referenced and attached to any conditions determined. One copy shall be returned to the subdivider, one copy sent to the City Engineer, one copy retained by the Commission and the fourth shall be sent to the City Manager.
 
   (e)   Expiration of Approval. Conditional approval of a preliminary plat by the Commission shall be effective for one year only. After the expiration, such approval shall be cancelled and rescinded unless extended in writing by the Commission.
 
   (f)   Conditional Approval Revocable. Conditional approval of the preliminary plat is revocable and shall not constitute approval of the final plat. It shall be deemed an expression of approval of the layout submitted on the preliminary plat as a guide to the preparation of the final plat, which shall be submitted for approval of the Commission and for recording upon fulfillment of the requirements of these Regulations and the conditions of the conditional approval.
