901.17 ABANDONMENT, OPENING, CLOSING OF STREETS; GRANTING RIGHTS OF WAY AND EASEMENTS; PAYMENT OF COSTS.
   Upon the application by any person or entity to abandon, open, or close any street or alley or portion thereof, or application to be granted a right of way or easement over or through any street or alley or portion thereof, the applicant shall file an application provided by the City Clerk, to include at a minimum the name(s), address(es), and telephone number(s) of the applicant(s), a description of the request and the reason therefor, the location of the portion of the street or alley sought to be affected, and a signed statement agreeing to bear all actual engineering, surveying, recording and related costs incurred by the City incidental to such action. The applicant or applicants shall at the time of making such application deposit with the City Clerk one hundred dollars ($100.00) as a deposit against the final costs incurred by the City, and which money shall be used to defray costs of public notice as provided herein. Prior to Council taking final action on such application, due notice thereof shall be given by the City Clerk to any person owning property within 200 feet of the affected area that the same will be considered at a meeting of Council, the date and time of which shall be set forth in said notice. Council may delay the effectiveness of any decision hereunder until the applicant pays all the costs required hereunder.
