781.01 PURPOSE.
   (a)    The purpose of this Article is to provide a simplified enforcement mechanism for the City of Moundsville to collect delinquent municipal fees and taxes, plus interest and penalties so that the City may provide services for the public good, by providing that liens shall be placed on property for security of payment due under various ordinances. A person or entity alleged to owe a delinquent fee or tax will be afforded due process and an opportunity to be heard, if requested, in the form of a fair and expedient hearing prior to imposition of a lien herein. A lien for delinquent fees and taxes will have a secured position and priority should the property be sold at a forced sale and the City may have the option of initiating a sale to enforce and collect the lien.
   (b)    The Council of the City of Moundsville finds that it is reasonable and necessary, through assertion of Home Rule powers, to fully utilize and expand West Virginia Code §8-13-13 to assist in a legal, equitable, and simplified form of recapturing monies expended to enhance public health, safety and welfare so that there will be an incentive for property owners to comply
with and pay the City such fees due for services rendered.
