§ 158.049 UNDERGROUND UTILITIES.
   (A)   Underground utilities requirements.
      (1)   All new electric distribution lines (excluding main line feeders and high voltage transmission lines), telephone service lines and services constructed within the confines of and providing service to customers in a newly platted residential area shall be buried underground.
      (2)   The subdivider is responsible for complying with the requirements of this section and shall submit to the Planning and Zoning Commission a written instrument from the utilities showing that the necessary arrangements with the utility involved for the installation of the facilities will be made.
   (B)   Exceptions. The foregoing requirements in division (A) above may be waived by the Council if, after study and recommendation by the Planning and Zoning Commission, either or both of the following are applicable to the proposed subdivision:
      (1)   The placing of electric and telephone utilities underground would not be compatible with the development planned; and
      (2)   Unusual topography, soil or other physical conditions make underground installation unfeasible from an engineering viewpoint or the cost impractical.
