§ 117.009 OWNER’S RESPONSIBILITY FOR COSTS.

   (A)   The owner of the site is responsible for the costs of vacating the site and surrounding areas, testing, clean up and public expenses.

   (B)   Public expenses will include all costs that have or may be incurred by the city and other public agencies including, but not limited to, costs for:

      (1)   Emergency response;

      (2)   Posting and physical security of the site;

      (3)   Notification of affected parties;

      (4)   Expenses related to the recovery of costs, including the assessment process;

      (5)   Laboratory fees;

      (6)   Cleanup fees; and

      (7)   Administrative fees.
