If, in the opinion of the county’s Department of Public Health or, in lieu of the county department, the Police Department, after an investigation thereof, any restaurant, café, dining room or eating house is operating in violation of § 111.004(A) of this chapter, the enforcing agency shall notify, in writing, the proprietor, owner or manager of the restaurant, café, dining room or eating house to place the same in a clean and sanitary condition within a reasonable time to be stated in the notice, which time so stated shall, in no case, be less than two days, and failure to comply with the notice within the time so stated shall be deemed a violation of the provisions of this subchapter.
